FanFixApp, LLC (collectively, “Company”, “we”, “us”, or “our”) takes data privacy and security seriously and believes in transparency.  PLEASE CAREFULLY REVIEW this Privacy Policy (“Policy”) that describes how we collect, use, share, and protect Personal Data that we collect from individuals who use, access or interact with our Business Operations (as defined below)(such individuals are collectively referred as “User”, “you” or “your”).  


For California, Texas, or Nebraska residents: Additional information regarding our privacy practices under state-specific privacy laws is available in Section 16 of this Policy.


PLEASE NOTE: This Policy does not apply to:


  • our HR-related data collection practices, where you act as our job applicant, employee, independent contractor, corporate officer. A separate HR-related privacy policy will be made available to you in that case. 
  • the User identity verification process operated by our select provider, Persona Identities, Inc. (“Persona”). Persona is responsible for the collection, analysis, retention, and destruction of your Personal Data that you provide to Persona during the Verification process in order to verify your identity and other eligibilities for registering your Creator Account, subject to Persona Privacy Policy and Persona Service Terms . For more details, please refer to Sections 2.1 and 2.2 regarding specific data collection practices for Identity Verification Data.


  • BY ACCESSING AND USING FANFIX OR ENGAGING IN COMMUNICATIONS WITH US, YOU CONSENT TO BE BOUND BY THIS POLICY AND AGREE TO THE COLLECTION, USE AND TRANSFER OF YOUR PERSONAL DATA FOR PROCESSING IN THE UNITED STATES AS DESCRIBED IN THIS POLICY.  IF YOU DO NOT AGREE WITH THE TERMS OF THIS POLICY, YOU SHOULD NOT ACCESS FANFIX OR INTERACT WITH US IN ANY MANNER.  Capitalized terms not defined herein shall have the meaning provided in the Terms of Service including Creator Terms and Fan Terms.


    What is In Scope for this Privacy Policy


    This Policy applies to the following:


  • WHAT INFORMATION WE MAY COLLECT. We want you to be in the know and provide additional information in Section 2 of this Policy.  We may collect your Personal Data through: 

  • “FanFix”, which refers to https://fanfix.io/ or any services provided therein, including mobile applications, sub-domains, clickable URL, and websites owned or controlled by FanFix with a link to this Policy or Terms of Service

  • Your “General Interactions” with us, which refers to an individual that requests information from or makes general inquiries to us, provides services to us on behalf of their employers or interact with us via business-to-business contacts, attends in-person or virtual conferences hosted by us, requests or receives our marketing information, engages with us through our social media pages, or where an individual’s images, videos or voices are used by us in marketing.
  • (collectively, our “Business Operations”).

    Our Business Operations, including FanFix, are housed on servers in the United States.  If you are located outside of the United States, please be aware that information and data we collect will be processed and stored in the United States, a jurisdiction in which the data protection and privacy laws and principles, including your data subject rights, may not offer the same level of protection as those in the country/region where you reside or of which you are a citizen.     1.    Introduction


    We want you to be in the know.  Here is what we cover under this Policy. 


    What is “Personal Data”? 


    “Personal Data” means information that can be used to identify you, directly or indirectly, alone or together with other information. This includes things such as your full name, contact information, email address, phone number, device IDs, certain network identifiers, and other categories described below, and may include Sensitive Personal Data to the extent you voluntarily share with another User via FanFix.  

    “Sensitive Personal Data” means Personal Data regarding a User’s (i) government-issued IDs, Social Security numbers, or other national identity numbers or documents; (ii) financial account information, including bank account, debit card, and/or credit card details; (iii) precise geolocation or other identifying information relating to a User’s specific locations that are considered private; (iv) username or email address in combination with a password or security question and answer that would permit access to an online account; or (v) other sensitive information, including biometric data, health insurance information, medical information regarding medical history, medical treatment, mental or physical condition, or medical records. 

    We may de-identify, aggregate, and/or anonymize your Personal Data by excluding and removing data components (such as your name, email address, or linkable tracking ID) through obfuscation, or through other means so that the resulting dataset is no longer personally identifiable to you (such resulting dataset is known as “Aggregated Data”). Our use of Aggregated Data is not subject to this Policy.


    2.    What Personal Data We May Collect


    We need your Personal Data to provide you a dynamic experience on FanFix. Please note that in some jurisdictions you must agree to the collection of your Personal Data in order for FanFix to provide its services.

    In order to provide FanFix to you, and through your use of FanFix, we may request you provide us with certain Personal Data.  We will indicate on the form whether a particular field of Personal Data is mandatory or optional.  If you choose not to provide certain Personal Data, we may not be able to make FanFix available to you.  Personal Data you provide to us through FanFix or otherwise includes:

    Profile Data


    • Such as your username and password that you may set to establish an Account with us and any content uploaded to FanFix, such as text, images, audio, and video, along with the metadata associated with the files you upload, which are defined as “Content” in the Terms of Service.

    Feedback


    Such as information you provide when you contact us with questions, feedback, or otherwise correspond with us online.

    Transaction Data

    Such as information about payments from you for products or Content you have purchased through FanFix, and your financial information to compensate you for your Content, in connection with facilitating the processes so that you are rewarded for your creative Contents available to other Users (as further described in the Creator Terms of our Terms of Service),

    Note that we do not store your credit card information (credit card number, name on card, security code, expiration date, and CVV), but our payment processor may store your Transaction Data for the purpose of facilitating payment.

    Identity Verification Data

    Such as photo ID (including your ID number, date of birth, effective date and expiration date) and other information provided by the identity verification processes (“Verification”)through Persona Identities, Inc. (“Persona”) to confirm your identity and other eligibilities for registering your Creator Account.
    How does it work? To make this process more efficient and secure, you will directly provide your Personal Data to Persona for completing this ID Verification process. This process may occur prior, during, and after your Account registration.
    Data collected by Persona. Where we leverage Persona's Verification services, we will send a Verification request to you through email with an activation link that will redirect you to Persona's verification portal. To complete the process, you will agree to Persona Privacy Policy and Persona Service Terms , and provide information as requested by Persona.
    ID Verification Data received by Us: Please refer to Section 2.2 (Biometric Data) below.

    Usage Data; Content Information


    We may access the following data categories as a result of your use of FanFix: 

    Usage Data: Such as information about how you use FanFix and interact with us, including information associated with any Content you upload to FanFix or otherwise submit to us, information you provide when you use any interactive features of FanFix, the URLs that referred you to FanFix, the areas within FanFix that you visit (including your activities there), 

    Interaction Content: Such as the content of Direct Messaging (as defined in Creator Terms), and related reactions, emoji, chats, comments, and a User’s responses to any challenges, call-to-attention and friendly competitions when interacting with other Users (which are collectively defined as “Interaction Content” in the Terms of Service).  

    Based on the foregoing data categories we collect through FanFix, we may draw inference regarding a User’s attributes, behavior and/or preference, and improve Users’ experience with FanFix. 

    Social Network Data


    We may collect Personal Data from your profile on a third-party social network, such as Facebook/Meta, Instagram, Twitter, LinkedIn and other networks (each, a “Linked Social Media Platform”), interact with or visit FanFix.  The Personal Data we may collect includes, but is not limited to, your name, username, user ID associated with your social media account, and email address.  In addition, FanFix may offer features that will allow you to share information to and from a Linked Social Media Platform, including your age, date of birth, gender, or and proof of identification (to the extent such data is made available to us by such Linked Social Media Platform in accordance with its privacy policy).  If you decide to use such features, you should check the privacy policy of each Linked Social Media Platform before using such features.

    Marketing Data


    We may collect your Personal Data, such as your preferences for receiving communications about our activities, events, and publications, and details about how you engage with our communications.  You may opt out from marketing emails in accordance with Section 9 (Your Choices to Control Your Information).

    Information From Creators 


    If you are a Creator, we may collect your name, image, contact information, and professional profiles (in addition to other data categories identified in this Table), to facilitate delivery of FanFix and/or your Content to other Users. We may also collect additional information relating to your social media account(s), age (verify 18+), tax identification number, company registration number, and/or VAT number, and where applicable, and a W9 from all Creators who want to create an Account on FanFix, in order to compensate you for your Content and other interactions with another FanFix Users. 

    Personal Data from Third Party Sources


    We may access or collect Personal Data from a third party when one User sends someone else a communication from FanFix, such as an invitation or a gift to a friend, the information we receive from such User (e.g., names, email addresses, mobile number, etc.) will be used to facilitate the communication. We require each FanFix User to ensure that s/he has the recipient’s permission to use his or her Personal Data for this purpose.

    When a User uses any “Referral” or “Send-a-friend” functionality made available by FanFix, your email address, mobile number, name or username and message may be included in the communication sent to your addressee(s).

    Other Information

    Other Personal Data we may collect which is not specifically listed here, but which we will use in accordance with this Policy or as otherwise disclosed at the time of collection.


    2.2. Biometric Data


    We use an age verification tool, operated on our behalf by Persona, to verify that Creators meet our minimum age requirements to access and use FanFix. Through Persona, we may collect, use, and/or process your face geometry, as well as other data that may be considered “biometric identifiers” or “biometric information” under applicable law (collectively, “Biometric Data”) , such as through uploading a face image or government-issued identification document during the age verification process. Any Biometric Data collected, used, and/or processed by us will be solely for purposes of identity verification, age verification, fraud prevention, and/or security or safety. FanFix and Persona may also share Biometric Data with each other for purposes of facilitating your use of the age verification tool and for the purposes referenced above.

    Any Biometric Data collected by us will be permanently deleted when you delete your FanFix account (i.e., at the time the initial purpose for our collection of biometric data has been satisfied), or in the event you maintain an Account but do not interact with us for a period of three years, whichever occurs early.


    2.3. Sources of Personal Data We May Collect


  • Personal Data You Provide Directly to Us. We may collect information about you when you provide it to us directly, including Account registration, completing surveys, questionnaires, or other webforms, or otherwise directly interacting with us with questions, feedback, or reports. 

  • Personal Data You Provide When Interacting with other Users.  We may collect information about you when you interact with other Users of the FanFix community including, but not limited to, comments, Direct Messaging, reactions, chats, and other Interaction Content.

  • Personal Data We Automatically Collect from You. We may collect Personal Data about you through cookies and other similar tracking technologies.  If you choose to disable such tracking technologies, some areas and features of FanFix may not work properly.  The information we collect from you via FanFix depends on the settings of your device(s) and/or browsers.  We recommend checking the polices and instructions of your device manufacturer(s) or browser provider(s) to learn what information they make available to us.

  • Personal Data We Collect from Third Parties.  We may collect your Personal Data from the following sources: 

  • Public records;
  • Service Providers, who collect data on our behalf;
  • Advertising Partners, who assist us with marketing or promotional services related to how you interact with FanFix;
  • Linked Social Media Platforms, if you choose to interact with us through your social media accounts. 

  • 3. How We May Use Personal Data


    We may use your Personal Data for various business or commercial purposes, which are outlined below.


    Our use of your Personal Data may fall under the following categories: 


  • Provide and Improve FanFix, including, without limitation, manage your Account, provide support and assistance to you; process orders, billing, and complete payments, donations, and other transactions; conduct product research and development, including testing, analyzing, and improving FanFix and our Business Operations; facilitate a User’s purchase of certain Contents, Direct Messages to Creators, make donations, and interact with other Users; and manage accounting records, analyze financial results, comply with internal audit requirements, obtain and maintain insurance coverage, manage risks, or obtain professional advice, and other activities relating to our Business Operations. 

  • Communicate with You and Conduct Marketing Outreach, including, without limitation, respond to your feedback, requests, questions, or inquiries; marketing our new features, products and services offered by us or through FanFix; communicate with you about the product or services offered by other Users that you follow or interact with; conduct marketing outreach on behalf of ourselves, and/or our business partners via emails, push notification, or SMS messages (You can opt out at any time by following steps outlined in Section 9 of this Policy); and personalize FanFix Content and communications based on your preferences.

  • Analytics and Performance. We use your Personal Data to create Aggregated Data, measure performance, and analyze key metrics relevant to our business, including the effectiveness of our marketing and advertising campaign, trend and business analysis.

  • Protect ourselves, our Users and Others, including, protect our rights in connection with Business Operations; fulfill our legal obligations, including preventing and investigating illegal activities; ensure the privacy and security of FanFix; detect fraud and prevent loss; protect the rights, property, or safety of you, FanFix, or other parties; and enforce this Policy and our Terms of Service

  • Other purposes related to the reasons for which you provided Personal Data to FanFix, and any other purposes with your consent, including those business purposes authorized by applicable privacy laws.

    Corporate Affiliates

    We may disclose your Personal Data to our corporate subsidiaries and affiliates and with their respective officers, directors, employees, and agents in order to provide and improve FanFix, and for approved marketing purposes.

    Service Providers and Business Partners

    We engage third party service providers, contractors, or business partners to assist us in the day-to-day business or commercial operations and to perform services on our behalf, including processing transactions, website hosting, data analysis, information technology, customer service, identity verification, fraud detection, and other services. We take commercially reasonable steps to ensure our third party vendors, contractors, or business partners provide at least the same level of protection for Personal Data as we do. In some cases, a third party provider may interact with you directly and collect your Personal Data for purposes of generating a report, confirmation, or determination as requested by us to verify your eligibilities to set up certain Account(s) and/or other Revenue Program(s). To the extent we do not receive, access, or store Personal Data that you provide to such third party provider(s), such data collection is subject to that third party provider’s privacy policies and/or applicable terms of use, which are made available to you to the extent required by appliable laws.

    Companies Involved in Mergers and Acquisitions Transactions

    If we sell or otherwise transfer part or the whole of our business or assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, or liquidation), any Personal Data collected through FanFix may be among the items sold or transferred.

    Professional Advisors

    We may share your Personal Data with our insurers and other professional advisors, including attorneys and accountants, that need access to your information to provide operational or other support services on our behalf.

    Law Enforcement, Government Agencies, and Courts

    We may disclose Personal Data at the request of law enforcement or government agencies; in response to subpoenas, court orders, or other legal processes; to establish, protect, or exercise our rights; to defend against a legal claim; to detect, investigate, prevent, or take action against illegal activities or potential threats to the rights, property, or safety of any other person; or as otherwise required by laws.

    Disclosures with Consent

    We may ask, from time to time, if you would like us to share your information with affiliated or unaffiliated third parties.  We will only disclose your information in this context with your consent as provided through our Terms of Service or otherwise. 

    Other Users

    When you create an Account and upload Content using FanFix, the information contained in your public profile and the Content displayed on or uploaded to FanFix (including a User’s image, audio recording, and video captured) may be viewable to other Users through FanFix, to the extent these other Users are given access to your profile and Content based on your Account settings.  You may change your settings at any time. Additionally, at the request of Creators, we may disclose certain  Personal Data of Fans to facilitate Direct Messaging or other communications between Fans and Creators or among Users.  


    5.    How We Protect Your Personal Data


    We recognize the importance of protecting your information and ask that you work with us to keep it confidential, safe, and secure. 


    We endeavor to use and maintain commercially reasonable physical, technical, and organizational security measures within FanFix to help protect Personal Data from unauthorized access, acquisition, use, alteration, or accidental loss.   Despite our efforts to store and protect Personal Data in a secure environment, no security system is perfect. We cannot guarantee the security of Personal Data during its transmission or its storage.  We do not represent or warrant that Personal Data about you will be protected against loss, misuse, or alteration by third parties.  The safety and security of your Personal Data also depends upon you.  When you use a password for access to restricted parts of FanFix, you are responsible for keeping your password confidential.  Do not share your password with anyone.


    6.    Accessing, Updating, or Deleting Personal Data


    Your Account settings put you in control of how you manage certain Personal Data. 

    You may use your Account to access or correct the information that you provided to us, or is associated with your Account, by logging onto your Account through FanFix. You may also request to access, correct, or delete your Personal Data by submitting a request via the contact information listed in How to Contact Us section below.  We will promptly review all such requests in accordance with applicable laws.  In certain circumstances, we may not be able to completely remove your Personal Data from our systems, as further discussed in Section 7 (Data Retention)


    7.    Data Retention


    Nothing is forever.  We have a few rules on how we retain your data. 


    We will retain your Personal Data only for as long as necessary to fulfil the purposes for which we collected and processed your Personal Data, to provide FanFix, or as required by applicable laws or other regulatory, accounting or reporting requirements.

    We take reasonable steps to delete the Personal Data we collect when (1) we have a legal obligation to do so, (2) we no longer have a purpose for retaining the information, or (3) if you ask us to delete your Personal Data, unless we determine that doing so would violate our existing, legitimate legal, regulatory, dispute resolution, contractual, or similar obligations.  We may also decide to delete your Personal Data if we believe it is incomplete, inaccurate, or that our continued storage of your Personal Data is contrary to our legal obligations or business objectives.  When we delete your Personal Data, it will be removed from our active servers and databases; however, it may remain in our archives when it is not practical or possible to delete it.


    8.    Cookies and Similar Technologies


    Cookie Opt-Out Tools: To disable sharing through cookies set on FanFix for advertising and analytics purposes, please adjust your settings by using Manage Cookie Settings option on the Cookie Banner. Residents of some states have additional rights to opt-out of the sharing or processing of their personal information for purposes of targeted advertising, as described in the U.S. State Specific Privacy Addendum section below.

    A “cookie” is a small file created by a web server that can be stored on your device (if you allow).  “Session” cookies are temporarily stored on your hard drive and only last until they expire at the end of your browsing session. “Persistent” or “permanent” cookies remain stored on your hard drive until they expire or are deleted by you. Local stored objects (or “flash” cookies) are used to collect and store information about your preferences and navigation to, from, and on a website. First-party cookies are set by the website you’re visiting, and they can only be read by that site. Third-party cookies are set by a party other than that website.  You can block and control cookies using the information noted below. If you block all cookies, certain functionalities on FanFix may not work.

    If you have chosen to identify yourself to us, we use cookies containing encrypted information to allow us to uniquely identify you. Each time you log into FanFix, a cookie containing an encrypted, unique identifier that is tied to your account is placed on your browser. These cookies allow us to uniquely identify you when you are logged into FanFix and to process your online transactions and requests.


    Functionality cookies

    Functionality cookies allow FanFix to remember information you have entered or choices you make (such as your username, language, or your region) and provide enhanced, more personal features. These cookies also enable you to optimize your use of FanFix after logging in. These cookies can also be used to remember changes you have made to text size, fonts and other parts of web pages that you can customize.


    We may use local shared objects, also known as Flash cookies, to store your preferences or display content based upon what you view on FanFix to personalize your visit.


    Performance cookies

    These cookies collect information about how you use FanFix, including which pages you go to most often and if they receive error messages from certain pages. These cookies do not collect information that individually identifies you. All information these cookies collect is aggregated and anonymous. It is only used to improve how FanFix functions and performs.


    From time-to-time, we may engage third parties to track and analyze usage and volume statistical information from individuals who visit FanFix. We may also utilize Flash cookies for these purposes.

    Marketing cookies

    Marketing Cookies deliver advertisements (“ads”) that may be more relevant to you and your interests.  They may be 1st party cookies or 3rd party cookies placed by us, by our service providers on our behalf, or by third party business partners with our permission.


    We, our service providers, or our business partners may use targeting or advertising cookies to track how you visit FanFix, browse pages on FanFix, and click on certain links.  These cookies help measure the effectiveness of our advertising campaigns.  


    We may also allow our third party business partners to use targeting or advertising cookies on the services for similar purposes, including collecting information about your online activities over time and across different websites.  They also perform functions, such as preventing the same ads from continuously reappearing, ensuring that ads are properly displayed, and in some cases selecting ads that are based on your interests.


    Other Similar Technologies


    In addition to cookies, there are other automatic data collection technologies, such as Internet tags, web beacons (clear gifs, pixel tags, and single-pixel gifs), and navigational data collection (log files, server logs, etc.), HTML Local Storage, Social Widgets, or UTM Codes that can be used to collect data as users navigate through and interact with a website.


  • Web Beacons: Web beacons (or Web bugs) are small strings of code that enable delivery of a graphic image on a webpage for the purpose of transferring data, such as the IP (Internet Protocol) address of the computer that downloaded the page on which the Web beacon appears, the URL (Uniform Resource Locator) of the page on which the Web beacon appears, the time the page containing the Web beacon was viewed, the types of browser that fetched the Web beacon and the identification number of any cookie on the computer previously placed by that server.  When corresponding with you via HTML capable email, Web beacons and similar technologies let us know whether you received and opened our email.

  • Tracking-Pixels:  A tracking pixel is a small piece of code we may use to collect and share with online advertisers’ information on your usage of FanFix, such as the pages that you have visited, or the way you have interacted with them.  Through the tracking pixels, your browser automatically establishes a connection with the server of an online advertiser.  In this way, the online advertiser receives information that you access FanFix.  This can allow us to ensure that we are serving ads that match your interests, when you are visiting any online advertisers’ websites, or a website that includes ads served by such online advertisers.  If you are authenticated to an online advertiser using tracking pixels, e.g., by being registered and logged in to a social network, the online advertiser can assign the visit to FanFix to your account.  We have no influence on the extent to which the data collected through the tracking pixels is used by the online advertisers and therefore direct you to their privacy notices.  Please note that, unlike cookies, you cannot control the deletion of tracking pixels yourself (e.g., by deleting them from your browser cache) because tracking pixels, unlike cookies, are stored on the servers of online advertisers and not in your browser.

  • Social Widgets: These are buttons or icons provided by social media platforms that allow you to interact with social media services when you view a webpage or mobile app screen.  These social widgets may collect browsing data, which may be received by the third party that provided the widget and are controlled by third parties.

  • UTM Codes: These are strings that can appear in a URL (the “Uniform Resource Locator,” which is typically the http or https address entered to go to a webpage) when you move from one web page or website to another.  The string can represent information about browsing, such as which advertisement, page, or publisher sent the user to the receiving website.

  • Particular third-party cookies or tracking technologies used on FanFix include, but are not limited to: 


  • Google Analytics: We may use Google Analytics to collect and process data about the number of people using FanFix and to better understand how they find and use FanFix. The data collected includes data related to your device/browser, your IP address, and on-site activities to measure and report statistics about user interactions on FanFix.  These third-party cookies remember what visitors have done on previous pages and how they have interacted with FanFix.  Google Analytics may also receive information about you from applications you have downloaded that partner with Google.  We do not combine the information collected through the use of Google Analytics with personally identifiable information.  Any data collected is used in accordance with this Policy and Google’s privacy policy.   • Datadog Session Replay Software.  We may use Datadog Session Replay (“Datadog”) and/or other similar software, which may enable FanFix to review, analyze, capture and visually replay the web browsing experience of users.  Such technologies may record your clicks, mouse movements, scrolling, form fills (keystrokes) in certain fields, page response times, length of visits to certain pages, pages visited and consent, time on site, web browser, operating system, device type, IP address, and similar metadata (“Usage Data”).  Datadog does not collect any information on pages where it is not installed, nor does it track or collect information outside your web browser.  We use this Usage Data to assess how you use and interact with FanFix to enhance user experience, analyze performance on traffic on FanFix, and improve and market our products and services.  The information collected by Datadog is anonymized and no Personal Data will be captured through these session recordings.  

  • By visiting and/or using FanFix, you hereby consent to the use of Datadog and/or other similar technologies, the collection of this data by FanFix and the recording of your experience on FanFix being accessed, collected, stored, and otherwise processed by FanFix, and our third-party service providers as set forth in this Privacy Policy.

    Choices About Cookies

    Email Communications Opt-Out: To provide you with information regarding FanFix or our other products or offerings, we may send you promotional materials or other information via email (“Email Communications”). You may choose to stop receiving Email Communications by clicking on the “Unsubscribe” link located at the bottom of any email we send to you. Please note that certain Email Communications that are transactional in nature (for example, emails about your order, or a change in terms and features of your Account) may not contain an unsubscribe link or opt-out instructions.  


    Text Messages (SMS) Opt-Out: We ask for your consent to receive text messages (including, messages with another Users, updates to FanFix, or our other products or services that you may be interested in), which may be sent by automated systems or technology.  You may unsubscribe from marketing text messages at any time by replying STOP or clicking the unsubscribe link (where available) in one of our messages.  For additional information, please review our Terms of Service


    Push Notifications or Other Notifications Generated Through Your FanFix Account: Where applicable, you may also adjust your mobile application’s settings or your Account settings to unsubscribe from push notification or other communications generated through your Account on FanFix. 


    Revocation of Permission:  For certain features of FanFix, you may opt-out by (i) contacting us according to Section 14 (How to Contact Us); (ii) if applicable, changing your Account settings; or (iii) if applicable, following opt-out instructions made available to Users at the time of collection or via other communications.  However, certain FanFix features may lose their full functionalities when you revoke your permission.


    10.    Children’s Privacy


    Only individuals over the age of 18 may use FanFix. 


    No part of FanFix is directed to children under the age of 18, and no one under the age of 18 may access, browse, or use FanFix or provide any information to or on FanFix. Consequently, we do not knowingly collect or directly solicit Personal Data from anyone under the age of 18, for which we may leverage Persona and/or other age verification methods. If you are under the age of 18, please do not submit any Personal Data about yourself to us through FanFix or offline. If we learn that we have collected Personal Data from a child under the age of 18 without a parent’s or legal guardian’s consent, we will take steps to stop collecting that information and delete that information as quickly as possible.  If you are a parent or guardian of a child under 18 years of age and you believe your child has provided us with Personal Data, please contact us by following instructions at the “How to Contact Us” section below.  


    11.    International Data Transfers

    We may transfer, or otherwise make available Personal Data that we collect from you outside of your home jurisdiction. 


    We may transfer, or otherwise make available Personal Data that we collect from you to countries outside of your home jurisdiction where we or our service providers and business partners operate.  Some of these jurisdictions may not have the same data protection laws as your home jurisdiction.  We will comply with applicable legal requirements when transferring Personal Data to countries other than the country where you are located.  If you are located in the EEA, UK, or Switzerland, we will transfer your Personal Data in accordance with adequacy decisions, standard contractual clauses, or other data transfer mechanisms compliant with applicable laws.  When we transfer your Personal Data to other countries, we will protect your Personal Data in accordance with this Policy or as otherwise disclosed to you.  By using FanFix or otherwise interact with our Business Operations, or requesting services from us, you understand and consent to the collection, storage, processing, and transfer of your information to our facilities in the United States and those third parties with whom we share it as described in this Policy. 


    When storing, hosting, or otherwise processing your information (including Personal Data), we may send such data outside of the EEA, UK, or Switzerland.  When we transfer information to other countries, we do so for the purposes set forth in this Policy and in accordance with applicable laws.  We rely on recognized legal basis to lawfully conduct cross-border/international transfers of Personal Data outside of the EEA, UK, or Switzerland, such as (i) your express informed consent to do so (as noted above), when transfer is necessary for us to deliver services pursuant to an agreement between us and you, (ii) for the conclusion or performance of a contract concluded in the interest of the data subject between the controller and another natural or legal person, or (iii) where the transfer is subject to safeguards that provide for the protection of your Personal Data, such as standard contractual clauses or other measures approved by the competent data protection authorities for the protection of Personal Data when transferred to a third country.  You may request such details by following instructions at the “How to Contact Us” section below.

    FanFix may contain links to websites, mobile applications or services operated and maintained by third parties, including Persona that operates the Verification processes. These links are connected to external websites and third parties that have their own privacy policies. If you follow any links that direct you away from FanFix, including links to social media sites, our payment processors, or to other websites, this Policy will not apply to your activities on the other sites you visit.  


    We are not responsible for the practices employed by these third party sites, including the information or content, and cannot guarantee the adequacy of the privacy and security practices employed by these third party sites.  A link to a third party’s website should not be construed as an endorsement.  We encourage you to investigate and ask questions before disclosing Personal Data to third parties.


    13.    Updates to This Policy


    We may modify or update this Policy from time to time.  


    You are expected to, and you acknowledge and agree that it is your responsibility to, carefully review this Policy prior to using FanFix and from time to time, so that you are aware of any changes.  If we make a change to this Policy that, in our sole discretion, is material, we will notify you as appropriate under the circumstances.  Unless otherwise indicated, any changes to this Policy will apply immediately upon posting to FanFix.  In all cases, your use of FanFix after “Last Updated” date listed on this Policy indicates your acceptance to the modified or updated Policy and your continued consent to our processing of your Personal Data according to the terms of the then-current Policy.

    This addendum of the Policy applies only if you interact with, use, or access FanFix from a country that is a Member State of the European Union or European Economic Area (collectively, “EU”), the United Kingdom (“UK”), or Switzerland, and it supplements the information in the remainder of our Policy, above.

    We may process your Personal Data in connection with any of the purposes and uses set out in this Policy based on one or more of the following legal grounds:


  • Performance of a Contract: As necessary to perform the Services you have requested or to comply with your instructions or other contractual obligations between you and us.

  • Right of Rectification. Our goal is to keep your Personal Data accurate, current, and complete.  Please contact us if you believe your information is not accurate or if it changes.

    16.    U.S. STATE SPECIFIC PRIVACY ADDENDUM


    This U.S. State-Specific Privacy Addendum (“U.S. Privacy Addendum”) supplements FanFix Privacy Policy and provides additional information regarding privacy rights provided under applicable U.S. state laws. The information below applies if you are a resident of the state(s) specified below, and the relevant rights will be available from the date when the applicable U.S. state laws and regulations take effect.   • Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards.

The term “sharing” includes disclosing or making available Personal Information to a third-party for purposes of cross-context behavioral advertising, and constitute a form of “sale”.


    “Sell” in this case does not mean providing data in exchange for money – we don’t do that. “Selling” or “sharing” instead means the disclosure or release of Personal Information, including technical device data that does not identify you directly but can be attributed back to identify you, when a third party might use that data for its own purposes, such as for personalized advertising or cross-context behavioral advertising, whether or not for monetary or other valuable consideration.


    While we do not “sell” Personal Information for monetary consideration, certain information exchange with our advertising and analytics partners regarding certain identifiers described under the categories of“Internet and Other Similar Activity” and “Inferences drawn from other PI” in Data Category Table above, may constitute a “sale” or “sharing” of Personal Information as broadly defined under California Privacy Laws. Such identifiers are classified as “Personal Information” under the California Privacy Laws and are collected automatically as a result of your interactions with FanFix.


    To the extent such exchanges occur, a California Consumer may exercise his or her rights under the Right to Opt-Out described in Section (B)(iii) of this Notice to California Residents.

    (i). Right to Know or Portability. As a resident of the State of California, you have the right to request that we disclose certain information to you regarding our collection and use of your California Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:


  • The categories of Personal Information we have collected about you;
  • The categories of sources from which we collect the Personal Information about you;
  • The business or commercial purpose(s) for which the Personal Information was collected, sold, or shared;
  • The categories of third parties with whom we disclose that Personal Information for a business purpose; and
  • The specific pieces of Personal Information we collected about you in a format easily understandable to the average Consumer (also called a“Data Portability Request”).

  • In addition, to the extent it is determined that our information exchanges constitute a sale or sharing of Personal Information under the California Privacy Laws, a Consumer shall have the right to request the business to identify, during the past 12 months:


  • The categories of Personal Information that we sold or shared, and the categories of third party recipients; and
  • The categories of Personal Information disclosed for a business purpose and the categories of recipients.

  • (ii). Right to Deletion. Subject to several exceptions, you have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions and as permitted under the California Privacy Laws.


    (iii). Right to Opt-out of “Sale” and Certain “Sharing” Practices. A California Consumer has the right to opt-out of the “sale” and “sharing” of your Personal Information with third parties, as those terms are defined under California Privacy Laws. “Sell” in this case does not mean providing data in exchange for money – we don’t do that (and we do not have actual knowledge that we sell Personal Information of minors under 18 years of age). You may opt out by using the “Manage Cookie Settings” or by broadcasting an opt-out preference signal.


    (iv). Right to Correct. Subject to certain restrictions, you have the right to request that we correct inaccurate Personal Information that we maintain about you. Our goal is to keep your Personal Information accurate, current, and complete. If you believe your Personal Information is not accurate (other than the one listed on your account, which you may modify at any time), you may submit a request by using the “How to Exercise Your California Privacy Rights” section of this Notice to California Residents.


    (v). Right to Limit Use and Disclosure of Sensitive Personal Information. In certain circumstances, a California Consumer has the right to limit the use and disclosure of Sensitive Personal Information. Our use of your Sensitive Personal Information is reasonably necessary to provide Content, products, or other services reasonably expected by an average Consumer and not for those purposes for which you may exercise a right to limit the use or disclosure under California Privacy Laws. While this Consumer right is not applicable to how we collect or use your Sensitive Personal Information, we provide this information as this is a core part of your rights as a California Consumer.


    (vi). Right to Non-Discrimination. We will not discriminate against you for exercising any of your rights under California Privacy Laws. Unless permitted by California Privacy Laws, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of goods or services; or
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

  • (vii). Other California Privacy Rights. California's “Shine the Light” law (Civil Code Section § 1798.83) permits California Consumers who are Users of FanFix to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. We do not disclose your Personal Information to third parties for their direct marketing purposes if you have exercised an option that prevents that Personal Information from being disclosed to third parties for those purposes.


    C. How to Exercise Your California Privacy Rights


    (i). Methods to Submit California Consumer Requests


    If you are a California Consumer and would like to exercise your rights under California Privacy Laws described above, you may do so via any of the methods described below:

  • Calling us at 1-888-611-0112; or
  • Sending an email to [email protected]

  • (ii). Authorized Agent. You may designate an authorized agent to make a request on your behalf. Authorized agents will be required to provide proof of their authorization. Individuals operating as an authorized agent on behalf of a California Consumer must provide a written authorization document, signed by the California Consumer, containing the California Consumer’s name, address, telephone number, and valid email address, and expressly authorizing the individual to act on behalf of the California Consumer. We may also require that you directly verify your identity and the authority of your authorized agent. We reserve the right to reject authorized agents who have not fulfilled the above requirements or automated requests under California Privacy Law where we have reason to believe the security of the requestor’s Personal Information may be at risk.


    (iii). Verification Procedures. We are required by California Privacy Laws to verify the identity of individuals who submit a Consumer request. The verifiable Consumer request must provide sufficient information that allows us to reasonably verify your identity and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. The information we may need in order to verify your identity differs depending upon the request made and our relationship with you and might include (as applicable) your name, the email address you regularly use to interact with us, your telephone number, your date of birth, etc. We will take steps to verify your request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information to verify your identity, or where necessary to process your request. We can only respond to your request or provide you with relevant information if we are able to verify your identity or authority to make the request. If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for the denial.


    (v). Response Timing: Upon receiving a Request to Know, Request to Delete, or Request to Correct, we will confirm receipt of the request within 10 business days and respond to the request within 45 calendar days from the date we receive your request. If necessary, we may take an additional 45 calendar days to respond to your request. If this extension is needed, we will notify you of the extension and explain the reasons that responding to your request will take more than 45 days. We are only required to respond to Requests to Know and Data Portability Rights twice in a 12-month period.

    This Notice is applicable to Texas and Nebraska residents.


    We set forth above in our Privacy Policy the categories of Personal Information we may process, the purpose for processing Personal Information, the categories of Personal Information we may share with third parties, and the categories of third parties with whom Personal Information is shared.


    This “Notice” applies if you are a resident of the State of Texas and Nebraska and explains how to exercise your data privacy rights as a resident of these states. The applicable state privacy laws in Texas and Nebraska (“State Privacy Laws”) provide certain residents (“State Consumer(s)”) with specific rights regarding their Personal Information.


    If you are a State Consumer from whom we control or process Personal Information that is within the scope of and subject to State Privacy Laws, you may rely on the Privacy Policy and the additional information below.


    A. Your State Privacy Rights. Subject to certain limitations and exceptions under the State Privacy Laws, State Consumers have the following rights:


    (i). Right to Access. You have the right to know whether or not we are processing your Personal Information as a controller and to access such Personal Information.


    (ii). Right to Correct. You have the right to request that we correct any inaccurate Personal Information that we have collected about you.


    (iii). Right to Delete. You have the right to request that we delete the Personal Information provided by or obtained about you.


    (iv). Right to Portability. You have the right to obtain a copy of your Personal Information (if such data is available in a digital format) that you previously provided to us in a portable and to the extent technically feasible, readily usable format to you to transmit the data to another controller without hindrance.


    (v). Right to Opt-Out. You have the right to opt out of the processing of your Personal Information for purposes of: (a) targeted advertising; (b) the sale of your Personal Information; or (c) profiling in furtherance of a decision that produces a legal or similarly significant effect concerning you as a State Consumer (as these processing activities are defined under State Privacy Laws). To the extent State Privacy Laws determine that information exchange involving Device ID or Interaction Information, or other information automatically collected by Cookies constitutes a “Sale” of Personal Information or other data processing activities for which you are eligible to exercise your “Right to Opt-Out”, please refer to “Manage Cookie Settings”.


    (vi). Right to Appeal. You have the right to appeal our denial to act on your request to exercise your rights under the State Privacy Laws. Under the applicable State Privacy Laws, we will respond in writing of any action taken or not taken within 60 days after receipt of the appeal.


    (vii). Right to Non-Discrimination. You have the right not to bediscriminated against for exercising your rights under the State Privacy Laws.


    B. Our Processes to Respond to State Consumer Request(s): As a controller, we shall:


  • Respond to your request to exercise State Consumer rights within 45 days after receipt. Where reasonably necessary, we may extend the response deadline by an additional 45 days as long as we notify you within the initial 45-day response window; or
  • Decline to take action regarding your request to exercise your State Consumer rights. In this case, we will inform you the reasons for which we decline within the initial 45-day response window and provide instructions on how to appeal our decision.

  • C. Exercising Your State Privacy Rights.
